ON TUESDAY, MARCH 4, 2008, THE BOARD OF ARCHITECTURAL REVIEW HELD A MEETING IN THE 2ND FLOOR COURTROOM OF THE WOODFORD COUNTY COURTHOUSE TO HEAR THE FOLLOWING APPEALS:

 

The meeting opened at 5:00 P.M. with those being in attendance as follows:

 

MEMBERS PRESENT: Larry Leach, Erin Shoot, Deborah Shockley, Kevin Locke, Jean Lawson

 

CONSULTANTS PRESENT: Paul W. Noel, Jr., Building & Zoning Inspector

 

Paul Noel began the meeting by swearing in Jean Lawson and Erin Shoot.

 

Paul Noel opened the meeting to elect an Office of Chairperson.  Kevin Locke nominated Deborah Shockley as Chairman, as seconded by Larry Leach.  Paul asked if there were any other nominations for which no one responded.  Jean Lawson motioned to close the nominations. 

 

Kevin Lock motioned to nominate Larry Leach for Vice Chair as seconded by Deborah Shockley.  Jean Lawson motioned to close nominations.

 

Paul asked for nominations for secretary for which Larry Leach nominated Kevin Locke as seconded by Erin Shoot.  Jean Lawson motioned to close the nominations.

 

NEW BUSINESS:

 

PUBLIC MEETING:            BOAR#03-001-2008-ALH Holding Company-Gunnison- 209 N. Main Street Allstate Insurance- OHB-2 Zoning District- Applicant is seeking a Certificate of Appropriateness in order to install one set of 2 ‘1” x 9’ 7/14- illuminated channel letters mounted on a raceway to match façade color. 

 

Paul indicated that they have not yet received a signed application from the owner due to a dispute between Allstate and the owner.  The height of the letters is the matter in dispute; however since the owner did not sign the application Paul advised the case cannot be heard today.  Paul further explained the owner wants a height of over 10” and the applicant submitted a height of 21”.  The applicant has since come back with a 14” request, but the owner still has not signed the application.

 

Larry Leach asked what the existing heights are for the other signs in that area.  Paul did not know at the time but believed the others were cabinet size. Deborah indicated the H & R Block sign was individual letters that was set on a raceway or channel.   Larry wanted to know if those letters were bigger then 14” and Paul thought they were.

 

Larry asked if there were zoning regulations that limit the height of the letters and Paul indicated there were not.      

 

 

PUBLIC MEETING:            BOAR#03-002-2008-American Legion Post 67-138 S. Main Street – OHB-2 Zoning District- To repaint “E.D. Scrogin & Co. “ sign located on the south side of building on the upper front end using black and white paint to return it to it’s original appearance. 

 

The applicant was from the Young sign company and he was representing the owner.  The applicant indicated the owner’s grandfather started the E.D. Scrogin & Co. many years ago.  The grandfather is now 90 years old and the original sign was put up in the mid 1890’s.  The owner wants to refurbish the sign before her father’s demise.  The sign is approximately 12’ tall and 20’ long and 240 sq feet.  The applicant has already spoken with the American Legion and they approve and have already signed off. It will cost the American Legion nothing.  The owner will pay for the entire refurbishing.  The applicant described how he would do the refurbishing and that it will likely take 10 days.  The applicant indicated the entire motivation is for the family and to keep the sign preserved for future generations and again will pay it for it out of pocket.  The only difference on the sign is that the owner wants to put “founded 1890” on the sign. 

 

Deborah asked where the “founded 1890” would be located and how large the writing would be.  The applicant indicated it would likely be in red writing and big enough that it could be read.

 

Deborah indicated she believes the Kentucky Main Street guide has something regarding promoting repainting of older signs.  Jean had the Kentucky Main Street guide and was able to find a picture of the sign.  Paul read page 39 of the Design guidelines which explained that if possible signs should be preserved. 

 

Larry Leach stated he drove by the wall and indicated the wall is in fairly good shape except for one spot above the word paints and it appears there are a couple of loose bricks.  The applicant stated he has not had a chance to take a close look at the wall and he would likely do moderate repairs so that he can expedite what the refurbishing of the sign.  If he believes there is something that would affect the integrity of the sign he will take care of it. 

 

Kevin Locke asked what kind of paint the applicant would be using. The applicant stated he would use oil based paint and it’s made by One Shot.  It is an industrial sign lettering paint specifically made for this. 

 

Jean Lawson wanted to know if the applicant would have to do any cleaning and the applicant stated he did not.  Erin Shoot wanted to know how far down the sign will go.  He noted it would take up the exact space that it already has.

 

Paul asked when the applicant brought the application in did he have a chance to talk to Pattie about the zoning ordinance.  The applicant said he did not.  The applicant stated he was not sure what it would qualify under.  Paul indicated that since it does not fall under any specific category that there would not be any regulations on it.  Jean Lawson continued to read the Kentucky Main Street guide and it does say there are conditional use or variance sign ordinances. Paul indicated that only applies if the sign identifies a business there which in this case it does not. 

 

Jean read further that allowances for historic signing techniques should be investigated for sign ordinances with due caution. She suggested that if the Board approves it, it be with the provision that it be run past building permits.  The applicant indicated once the Certificate of Appropriateness was approved he would sit down with Paul and discuss whether or not he needs to apply and pay for an application for a permit.

 

Larry Leach moved to accept the proposal and issue a Certificate of Appropriateness as seconded by Kevin Locke.  Motion 5-0 in favor.  

 

The applicant indicated it may be worth creating an ordinance for enhancing a historic sign.

 

Deborah asked if there was anything else we needed to do. 

 

Kevin Lock motioned to adjourn the meeting as seconded by Erich Shoot. Motion 5-0 in favor.
