ON MONDAY, DECEMBER 3, 2007, THE BOARD OF ADJUSTMENT HELD A MEETING IN THE 2ND FLOOR COURTROOM OF THE WOODFORD COUNTY COURTHOUSE TO HEAR THE FOLLOWING APPEALS:
Chairman Sam Dozier III opened the meeting at 6:00 P.M. with those being in attendance as follows:
MEMBERS PRESENT: Sam Dozier, David Prewitt, Frank Stark, Jennifer Steen, and Tim Turney
CONSULTANTS PRESENT: Paul W. Noel, Jr., Building & Zoning Inspector; and Mary K. Woodrum, Recording Clerk.
CONSULTANTS ABSENT: Tim Butler, Legal Counsel
MINUTES: Mr. Turney moved, as seconded by Mr. Prewitt, to accept the November 5, 2007 minutes as distributed. Motion carried with all members voting 'aye'.
NEW BUSINESS
PUBLIC HEARING: DIMENSIONAL VARIANCE : Hassan Karbach - 920
12-023-2007 Huntertown Road - R-1B Zoning District - Section 504.2 - Applicant is seeking a 6 inch height variance from the 42 inch height requirement in order to install a 48 inch tall (3 board vinyl) fence in the front yard setback.
Mr. Noel stated the applicant wants to install a vinyl fence in the front yard. He explained that this is a three ranch rail vinyl fence which is made to be 48 inches high. There was consideration to lower this to 42 inches, however, this would cause the bottom rail to be directly on the ground. He went on to say that the applicant thought he could have a 48 inch high fence in this area until he came in to obtain a fence permit.
Mr. Noel stated Mr. Karbach felt the fence will enhance the vicinity and bring in a hint of agriculture in a residential area. He then explained to the northwest of this property, there is a 6 foot privacy fence that this will connect to that continues on northwesterly. He explained that these fences are in the rear yard of the adjoining houses. This is the only house in that development that faces Huntertown Road. Mr. Noel noted that there have been no calls or concerns from anyone about this request.
At this point, Mr. Dozier asked the applicant if he would like to address the Board? Mr. Karbach stated no, that Mr. Noel had covered it perfectly.
Mr. Dozier asked the Board members if there were any questions? With none, he closed the hearing and asked for a motion?
Mr. Stark moved, as seconded by Mr. Prewitt, to grant Hassan Karbach of 920
Huntertown Road , a 6 inch height variance from the 42 inch height requirement in order to install a 48 inch tall (3 board vinyl) fence in the front yard setback. Motion carried 5-0 in favor.
PUBLIC HEARING: CONDITIONAL USE PERMIT : St. Leo Parish - 295
12-104-2007 Huntertown Road - R-1B Zoning District - Section 706.4 , 705.4 (B & E) - Applicant is seeking a Conditional Use Permit in order to build a Parish Life and Education Center addition.
Mr. Noel stated this is part of a long range development of this area for St. Leo Parish. He then asked the members to look at the site plan that shows the details of how this new education center fits in with the church and the existing land. They have entered into an agreement with Taylor Manor Nursing Home to obtain 50 additional feet on the west side of the property. Mr. Noel stated there have been no comments or calls from anyone.
Mr. Dozier then asked if the applicant would like to address the Board? Ms. Jeanne Box, Development Director at St. Leo, came forward and stated she would be glad to answer any questions that the Board might have. She did note that the education center section of the building will be the home of St. Leo's School.
Mr. Dozier asked if there were any questions or concerns from Board members. With none, he asked if there were any questions from the audience? With none, Mr. Dozier closed the hearing and asked for a motion?
Mrs. Steen moved, as seconded by Mr. Prewitt, to grant St. Leo Parish of 295
Huntertown Road, a Conditional Use Permit in order to build a Parish Life and Education Center addition. Motion carried 5-0 in favor.
Mr. Dozier asked for a motion to adjourn?
