ON MONDAY, APRIL 7TH, 2008, THE BOARD OF ADJUSTMENT HELD A MEETING IN THE 2ND FLOOR COURTROOM OF THE WOODFORD COUNTY COURTHOUSE TO HEAR THE FOLLOWING APPEALS:

 

DIMENSIONAL VARIANCE :  Case #: 04-007-2008

John & Jane Pryor- 260 Morgan Street - OHR-2 Zoning District - Section 708.6 - Applicant is seeking a 10 foot front yard variance along Church Street from a 25 foot required setback in order to build a garage 15 feet from the right-of-way of Church Street

 

DIMENSIONAL VARIANCE:   Case#: 04-008-2008

Jason DeBold /Paul & Marilee Lesley- 131 Blackburn Court - R-2 Zoning District- Section 504.4 A & Section 708.6 - Applicant is seeking a 16 ½ foot variance to allow an accessory structure to be built within 8 ½ feet of the front  lot line.  Also a variance to allow the accessory structure to be built in other than the rear yard. 

 

 

Chairman Sam Dozier III opened the meeting at 6:00 p.m. with those being in attendance as follows:

CONSULTANTS PRESENT: Paul W. Noel, Jr., Building & Zoning Inspector and Petra T. Dotson, Recording Clerk.

 

MINUTES:      Tim Turney moved, as seconded by David Prewitt, to accept the March 3rd, 2008 minutes as distributed. Motion carried with all members voting ‘aye’.

 

NEW BUSINESS:

 

DIMENSIONAL VARIANCE :  Case #: 04-007-2008

DIMENSIONAL VARIANCE:   Case#: 04-008-2008

Jason DeBold /Paul & Marilee Lesley- 131 Blackburn Court - R-2 Zoning District- Section 504.4 A & Section 708.6 - Applicant is seeking a 16 ½ foot variance to allow an accessory structure to be built within 8 ½ feet of the front lot line.  Also a variance to allow an accessory structure to be built in other than the rear yard. 

 

 

Chairman Dosier read the case as listed on the agenda and requested Paul Noel provide an explanation of the case.  Paul Noel stated that the applicant has no room in the rear yard to do anything, the house sits way back in to the lot.  He noted the applicant has cars and other items needing storage and in order to get something suitable and accessible from the driveway they have chosen the site on the site plan.  He also noted the property lines proceeds any zoning regulations that are in effect.  He stated the applicant wants to build to reproduce the architectural detail of the house with brick and requested the applicant elaborate further since this pertains to the structure.  Paul asked the applicant if the road that heads out to the side is non existent.  Applicant DeBold stated he could not find a record anywhere with regards to the road and that the road has always been utilized. 

 

Frank Stark asked if the remainder of the road is owned by the city.  Applicant DeBold indicated that TI (city of Versailles) owns it beyond his client’s property line.  There is no ingress/egress attached to that or anything he can find in the records dating back to 1940.  Chairman Dosier noted that there are some homes on Blackburn Court off that road and therefore the road has to stay there.  Frank Stark indicated he did not want the road closed, he just wanted to point out that it is not a true road but that the homes will still have access to the road.  Paul Noel noted the road comes behind McCauley Feed.

 

Paul Noel indicated there have been no calls in the office from anybody, whether yeah or nay.  Chairman Dosier asked if the applicant wanted to address the board.  Applicant DeBold  stated he would be happy to answer any questions and that his client wants to recreate the architectural integrity of the existing structure. He noted they wanted to save the property for future generations.  Applicant DeBold noted they are calling it a Carriage House.  He stated his client’s chose this particular site because they wanted to try to preserve as many trees as possible.  He noted they will likely lose a few but they are young and they are not the prime botanical specimens on the property.

 

Tim Turney asked if the variance of 8 ½ feet in the front line and the variance for an accessory structure pertains to the same structure.  Applicant DeBold confirmed it was for the same structure.  Paul Noel noted that there is a front set back to start with but also the ordinance says that any accessory structure will be built in the rear yard.

 

Frank Stark asked who owns 105 Blackburn.  Applicant DeBold indicated Danny Dawson was the owner of that residence.  Jennifer Steen asked if they have spoken with Mr. Dawson and has he said anything about the variance request.  The applicant stated Mr. Dawson has told them he is thrilled.

 

Paul Noel indicated he would have had the opportunity to contact us because notifications were sent out.  Applicant Debold indicated all surrounding owners have been notified.  From what he understands, all neighbors are happy that there will be light at the end of the road. 

 

Chairman Dosier asked the board members it there were any other questions.  The board members did not.    

 

Chairman Dosier asked if the members had any other things they wanted to discuss.  Since the answer was no, Chairman Dosier asked the members for a motion to either deny or grant the dimensional variance.  Tim Turney moved, as seconded by Frank Stark to approve the motion.  Motion carried 5-0 in favor. 

 

Tim Turney moved, as seconded by Jennifer Steen to adjourn the meeting at 6:10 p.m.  Motion carried 5-0 in favor.
