AGRICULTURAL ADVISORY REVIEW COMMITTEE

WOODFORD COUNTY, KENTUCKY

 

                                                     ARTICLE I

                                                  OBJECTIVES

 

The purpose of the Agricultural Advisory Review Committee of Woodford County, hereinafter referred to, as the “AG COMMITTEE” is to review applications and make recommendations with respect to farm activities as agricultural enterprises, such as agri-tourism enterprises or agricultural tourism, to the Board of Adjustment, as set forth in Article IV, Section 401 (B)(3)(A) and Article VII, Section 701.4 (J) of the Versailles-Midway-Woodford County Zoning Ordinance.

           

                                                    ARTICLE II

                                  OFFICERS AND THEIR DUTIES

 

SECTION 1

 

The officers of the AG COMMITTEE shall consist of a chairperson (hereafter referred to as Chair), vice-chairperson/secretary (hereafter referred to as Vice-Chair).

 

SECTION 2

 

The Chair shall be the presiding officer at all meetings of the AG COMMITTEE and shall perform their duties and conduct all meetings.

 

SECTION 3

 

The Chair’s general duties are: To open and call the meeting to order; to announce the business to be conducted; to recognize members entitled to the floor; to state and put to vote all questions which are regularly moved or necessarily arise in the course of proceedings and to announce the result of the vote; to vote on all matters if they so choose; to protect the AG COMMITTEE from unnecessary or frivolous motions by not recognizing them; to speed up proceedings as much as possible; to require order and sincerity in meetings; to inform the group present to a point of order or a practice pertinent to pending business; and to authenticate, by their signature when necessary, all acts, orders, and proceedings of the AG COMMITTEE.

 

SECTION 4       

 

The Chair shall conduct business only for the benefit of the AG COMMITTEE and shall reflect no personal prejudice in any matter.


SECTION 5

 

The Vice-Chair shall assist the Chair in any way possible subject to the Chair’s request.  Upon the absence of the Chair, the Vice-Chair shall automatically become the presiding officer of the   AG COMMITTEE and shall assume all the powers, duties and responsibilities of the Chair. 

 

 

SECTION 6

 

The Vice-Chair’s duties as Secretary are as follows: To keep records and minutes of each meeting of the AG COMMITTEE; to keep a roll of the members and to call this roll when required; to notify officers and the members of their appointment and to furnish committees with all papers referred to them; to record the number of votes for and against each question put to vote; to indicate any absences or disqualifications from voting when a question is put to vote; and other duties which may be assigned to them. 

 

 

 

                                                                ARTICLE III

                     NOMINATION AND ELECTION OF OFFICERS

 

SECTION 1

 

Nominations for and elections of officers shall take place at the first regular meeting of each calendar year.  All officers shall be eligible for re-election at the expiration of their term.

 

 

SECTION 2

 

Election of officers shall take place immediately following nominations.  Voting shall take place in one of the following ways: voice, show of hands, rising, balloting, or roll call.

 

 

SECTION 3

 

A candidate receiving a majority vote of the entire membership of the AG COMMITTEE shall be declared elected, shall immediately take office, and shall serve for a term of one (1) year or until a successor is elected and takes office.

 

 

 

 

SECTION 4

 

Vacancies in unexpired terms of office shall be filled immediately by regular election procedures.

 

                                                                ARTICLE IV

                                                 MEMBERSHIP

 

SECTION 1

 

The AG COMMITTEE shall consist of a total of 4 (four) members appointed by the County Judge/Executive, subject to the approval of the Woodford County Fiscal Court.

 

SECTION 2

 

The term of office of the members shall be for four (4) years, except the terms of the original appointments.  In order to create a staggered re-appointment schedule, the original appointment terms will be 1 year, 2 years, 3 years, and four (4) years for the four (4) members.

 

SECTION 3

 

Whenever a vacancy occurs, the AG COMMITTEE Chair shall immediately give the Woodford County Fiscal Court notice that the vacancy exists.  The Fiscal Court shall have sixty days from the date the vacancy occurs to fill the vacancy.  If the Fiscal Court fails to act within that time, the matter shall be referred to the Woodford County Farm Bureau and the Woodford County Extension Advisory Council for a nomination. If the Fiscal Court does not approve such nomination within 30 days, the nomination becomes effective.  When a vacancy occurs, other than through expiration of the term of office; it shall be filled for the un-expired portion of the term.

 

 

ARTICLE V

                                                    MEETINGS

 

SECTION 1

 

A quorum is a simple majority of the total membership of the AG COMMITTEE as established by the regulation or agreement.  Any member of the AG COMMITTEE, who has any financial interest or conflict in the outcome of any review before the committee shall disclose the nature of the interest and shall disqualify themselves from voting on the question.

 

 

SECTION 2

 

A simple majority of the total membership of the AG COMMITTEE shall constitute a quorum.  Before any business can be conducted by the AG COMMITTEE of a quorum must be present at a properly called meeting.  To transact any business, including reviews to the AG COMMITTEE, a simple majority vote of those present shall be required.  In the event of a tie vote on a review before the AG COMMITTEE, further consideration shall be given and another vote shall be taken at the next regularly scheduled meeting.  In the event that a tie vote occurs once again, the application shall be forwarded to the Board of Adjustment without a recommendation.

 

SECTION 3

 

Regular meetings shall be held on the first Wednesday of each month at 7:30 AM, at the Woodford County Courthouse, or other place designated by the Chair.  The meetings will adjourn no later than 9:00 AM.  Other meetings shall be conducted at the call of the Chair.  For all meetings the Chair shall notify all members of the AG COMMITTEE by oral or written notice not less than seven (7) days in advance of all meetings.  This notice shall contain the date, time, place, and subject (s) of discussion.  No other business may be discussed except by unanimous consent of the AG COMMITTEE.  The Chair may delegate the task of giving notice to the Planning Director.

 

SECTION 4

 

All meetings at which action is taken shall be open to the general public.

 

 

                                                                ARTICLE VI

                                   TRANSACTION OF BUSINESS

 

SECTION 1

 

Any member of the AG COMMITTEE who has any financial interest in any question called to vote, shall notify the AG COMMITTEE of such interest and thus disqualify him or herself from voting on the matter.

 

SECTION 2

 

Any member of the AG COMMITTEE, who fails to notify the AG COMMITTEE of their financial interest in a question called to vote, shall have their voting qualifications judged by the AG COMMITTEE as to their amount of interest in the question and their right to vote on it.

 

SECTION 3

 

Any member of the AG COMMITTEE found to have any financial interest or conflict in a question called to vote shall not be considered in the quorum count prior to voting.

 

 

                                                               ARTICLE VIII

                                                  EMPLOYEES

 

SECTION 1

 

The AG COMMITTEE may employ a clerk to assist the Vice-Chair in the performance of their duties and perform such other duties as may be assigned to them by the Chair upon approval by the Planning Commission.

 

 

                                                                ARTICLE IX

                                            PUBLIC MEETINGS

 

SECTION 1

 

In addition to those required by law, the AG COMMITTEE may hold public meetings at its discretion when it is apparent that such meetings will be in the public interest.

 

SECTION 2

 

The AG COMMITTEE shall meet to discuss any applications after public notice has been given in accordance with Kentucky Revised Statute, Chapter 424 as well as written notice to the applicant and the planning director least one-week prior to the meeting.

 

SECTION 3

 

The matter before the AG COMMITTEE shall be presented in summary by the Vice-Chair, the Planning Director, or a designated member of the AG COMMITTEE.  The applicant shall next have privilege to the floor in order to make their presentation.  Other interested persons next have privilege to the floor.  All questions and discussion shall be directed by the Chair to the various speakers for response, and only the Chair may direct questions to persons present at the meeting.

 

SECTION 4

 

In the event that a party who has requested a review by the AG COMMITTEE requests after the legal notice has been published that the public meeting be postponed, said party shall bear the expense of any subsequent legal notice publication.  In the event that a party who has applied to the   AG COMMITTEE fails to appear at the public meeting and the AG COMMITTEE is unable to render a decision based on the information previously submitted by the party, the AG COMMITTEE may postpone the meeting, and said party shall bear the expense of any subsequent legal notice publication.  Any party who has appealed to the AG COMMITTEE and who after the legal notice has been published withdraws their application shall be precluded from filing the same or similar application for a period of six (6) months from the date of the AG COMMITTEE’S action.

 

The AG COMMITTEE may, in its discretion, by the vote of a simple majority of the total membership waive the six (6) month limitation on filing the same or similar applicaation.

 

SECTION 5

 

A record shall be kept of those speaking before the AG COMMITTEE by the Vice-Chair.  Any requests for a transcript may be made by a party.  The request must be made within 90 days following the public meeting, and the cost of preparation shall be borne by the requesting party.

 

                                                                 ARTICLE X

                                                AMENDMENTS

 

SECTION 1

 

These bylaws may be amended by a vote of a simple majority of the total membership of the   AG COMMITTEE.
