NEW BUSINESS:

 

1.                   Second Amended Development Plan – Kentucky Bank – Lot 3 – 520 Marsailles Rd.

 

2.                   Final Plat – Hiddenaway Estates- Sections 1 & 2 – 905 Pinckard Pike – 24 lots - Rural Residential District.

 

3.                   Final Plat – Wooldridge Gardens, Phase II – Section 1B and Section 2A – McCowans Ferry Rd. – 61 lots – R-1C PUD District.

 

4.                   Final Plat – Wooldridge Gardens, Phase II – Section 3A – Abbey Road and School House Road – 26 lots – R-1C PUD District.

 

5.                   Final Development Plan – St. Andrews Anglican Church – 124 Dry Ridge Rd. – 1 lot - A-1 District.

 

6.                   PUBLIC HEARING:  Zoning Map Amendment and Conceptual Development Plan and Preliminary/Final Plat – Dorothy Jones Property – Tract 5, 226 Jones Lane – 1.800 acres from A-2 to Rural Residential and 7.200 from A-2 to Rural Residential/Residual Farmland.

 

7.                   PUBLIC HEARING:  Zoning Map Amendment and Preliminary Development Plan – “The Crossings” –  located off Lexington Street and US 60 – 2.3641 acres from I-1 to B-4, 0.8504 acres from I-1 to B-4, 0.2088 acres from I-1 to B-4, 0.8504 acres from I-1 to B-4, 0.3998 acres from I-1 to B-4, 0.0754 acres from I-1 to B-4, for a total of 3.898 acres from I-1 to B-4.

 

8.                   PUBLIC HEARING:  To review and possibly amend revisions to the Versailles-Midway-Woodford County Amended Subdivision Regulations adopted March 27, 2003 as follows:

 

Article I    Add new Section 180 –  Penalties/Violations

Article II   Definition 255 - Revise definition of Performance Guarantee to only allow Certificates of Deposit.

Article III Section 330 (C) – Construction - Revise last sentence to include sidewalks and street trees.

                                    Section 340 (B)(2)- Require a reduced set of As-Builts.              

                        Section 340 (C)(2)- Change bonding to performance guarantee and add sidewalks                                    and street trees .

                                    Section 340 (C)(3) – Change bond to surety.

                                    Section 350 Revise to include sidewalks and street trees.  Require a separate CD                                     for street trees.

                        (A)(1)Add non-residential subdivisions require 10% deposit of costs with CD when                                               grading permit issued.

                        (A)(2)Revise to include sidewalks and street trees, a reduced set of plans, change bond to                                     surety.

                        (B) Revise bond to surety, add sidewalks and street trees, change to 115%

                        (C) Certificate of Deposit only allowed with interest staying part of CD.  

                        (D)(1) Add a two year cap and require subdivider to reappear before Commission for                                           extension and an increase of 10% or as determined by engineer if extended.

                        (D)(2) Change to Final Improvements and bond to CD.

                        (D)(3) Change Bond to CD.

                        (D)(5) Add new line regarding no partial releases/reductions.

                        (E)Add provision if CD is called the governing holder shall get the accrued interest and                                         use all for completion.

Article IV        Section 420 – Final Plat

                        (C)(5)Revise Engineer’s Certificate to be for designated final improvements instead of                                          just blacktop, cleanup & contingencies.

                        (D)(3) Revise to include sidewalks and street trees.

                        (D)(6) Revise to allow only a CD.

Article VI        Section 620 - Streets

                        (D)(17) Create a new regulation about posting signs at the end of Stub Streets indicating                           that the road will be extended with future development.

                        (I) Sidewalks will be 6” thick under driveway crossings.  Add that they can also be                                   bonded with certain provisions.

                        Section 680 – Streetscape Standards

                        (B) Add that a separate CD can be posted for street trees.

                        (D) Add that the Planning Director can approve change in species of street trees without                          amending plat.

                        Section 690 - Miscellaneous 

                        (A)Add directives for maintenance and replacement of trees in platted Tree Protection                             Areas.

9.                   To review and possibly amend revisions to the Versailles-Midway-Woodford County New Urban Subdivision and Site Plan Regulations adopted March 27, 2003 as follows:

 

PART 1 General Provisions -1.1.14 Penalties/Violations - Add new section on penalties                                   and violations.

PART 2 Design Standards for All Roadway Types - 1.2.09 V – Stub Street Signage-Create    a new regulation about posting signs at the end of Stub Streets indicating that the    road will be       extended with future development.        

1.2.25 (F) As-Built Construction Plans – Require a reduced set of As-Built plans

PART 3 Streetscape and Canopy Shade Tree Standards - 1.3.03 (B) (5a) Sidewalks Sidewalks will be 6” thick under driveway crossings.         

1.3.03.(B) (5b) – A Certificate of Deposit (CD) can be posted for incomplete sidewalks   with certain provisions.

PART 7 Installation of Improvements - 1.7.06 (B) Security Required

Add that performance guarantees are required in the form of a CD.

1.7.07 (C) Release from Requirement to Guarantee Proper Functioning

Correct that applicable Engineer recommends to the Planning Commission release of CD. No reduction or partial releases allowed.

1.7.05 (C) (6) Notice of Bond Requirement with the following language – Change Bond to CD.

1.7.06 (A) Installation of Improvements –Add procedure for posting the performance guarantee specifying only for final surface course, sidewalks, street trees and clean up.

1.7.06 (B) Installation of Improvements in Non-Residential Subdivisions

Add that non-residential subdivisions require a 10% deposit of costs with CD when grading permit issued.

1.7.07 (A) Release from Requirement to Guarantee Proper Functioning

Revise procedure to release CD.

1.7.07 (B) Specify that the applicable Engineer must do inspections and remove going to Technical Review.

1.7.07 (C) Specify how to release CD with no partial reductions

1.7.07 (D) Delete all and add procedure for establishing sureties in form of CD’s upon submission of As-builts.

1.7.08 (C) Revise bonds to CD’s

 

PART 8 Installation and Maintenance of Improvements

1.8.05 Performance Guarantee is Required – Specify performance guarantee to be a CD.

1.8.06 Acceptable Guarantees – Delete all types of performance guarantees except for CD and that it is only for surface of blacktop, sidewalks and clean up with a separate CD for street trees.

1.8.06 (A) Change from 110% to 115%.

1.8.07 Effective Period of Guarantee – State that interest accrued will remain with CD.

1.8.08 Extensions and Substitutions

Specify when 80% of lots have Certificates of Occupancy or 2 years have passed, whichever comes first that final improvements must occur. If not an extension may be granted by Commission but CD amount will increase by a minimum of 10% or as determined by applicable Engineer.

1.9.09 Default – Specify if improvements are completed as specified the CD can be cashed by governing body and improvements can be completed with those funds, including any earned interest.

1.8.13 (E) As-Built Drawings – Specify what form As-Builts will be submitted in.

1.8.15 Posting of Defect Security – Specify that a Certificate of Deposit from a Kentucky bank will be posted with the appropriate legislative body.

1.8.18 Reduction or Release of Guarantee – Remove procedure for reduction of guarantee and add process for release.

1.8.20 Building Permits Prohibited – Delete this section.

During construction the developer/builder may, by filing of a performance guarantee for all the remaining improvements not yet accepted by the applicable City or County Engineer in accordance with these regulations, have a prior conditional Record Plat recorded.

PART 10 Definitions -

1.10.04 – Defect Security -Specify that the Defect Security is only a CD as approved by the Commission and it is payable to appropriate legislative body and Subdivider and held by said legislative body.

1.10.04 – Performance Guarantee – Add that security must be in the form of a CD approved by Commission.
